1. scope of application

The International Flyfishers Club, Robert-Blum-Str. 5b, D-22453 Hamburg, E-Mail:Info@internationalflyfishersclub.com, operates the International Flyfishers Club online store (since 1999) at https://www. internationalflyfishersclub.com. For all orders in the International Flyfishers Club online store, these General Terms and Conditions apply in the version valid at the time of the order. Your contractual partner for orders in the International Flyfishers Club-Online-Shop is exclusively International Flyfishers Club, regardless of whether the delivery is carried out by International Flyfishers Club-Online-Shop itself or by a supplier of International Flyfishers Club.

The goods will be delivered by German Post. A contract is concluded exclusively with International Flyfishers Club. Then the present terms and conditions apply.

2. conclusion of the contract in the online store

The presentation of the products in the International Flyfishers Club online store does not constitute a binding offer to conclude a purchase contract. Only by pressing the button “Buy now” you make a binding offer to conclude a contract. Before doing so, you have the opportunity to check and correct the contents of the virtual shopping cart as well as your address data. You can also cancel the ordering process at any time by closing the browser.

After submitting your order in the International Flyfishers Club online store, you will receive a confirmation e-mail (confirmation of receipt). This is not yet a confirmation of contract by us. The acceptance of your offer to conclude the contract will be made by a separate e-mail (order confirmation) or by sending the goods. If you have not received an order confirmation or notification of delivery or no goods within seven days, you are no longer bound by your contract offer. In this case, any services already rendered will be refunded immediately. Your legal right of withdrawal according to clause 3 remains unaffected. Articles, in particular also offer articles, are delivered only in household-usual quantities.

3.1 Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last item.

by means of a clear declaration (e.g. by e-mail) about your decision to revoke this contract. You can use the attached online store cancellation policy for this purpose, but this is not mandatory. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

3.2 Consequences of revocation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us or to the supplier indicated on the return label without undue delay and in any case no later than within fourteen days from the day on which you informed us of the revocation of the contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to your handling the goods in a way that is not necessary for testing the quality, characteristics and functionality of the goods.

3.3 Exceptions to the right of revocation

According to § 312g para. 2 BGB, the right of withdrawal does not apply, among other things, to goods that can spoil quickly or whose expiration date would be quickly exceeded. Furthermore, the right of revocation does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The prices listed in the International Flyfishers Club online store are Euro prices and include the statutory value added tax.

5. minimum order value | shipping costs

There is no minimum order value (value of goods) for your order with us in the online store. The real shipping costs incurred will be charged.

Additional shipping costs will be displayed to you depending on the shopping cart during the ordering process. Please note that “value of goods” means the price including VAT after deduction of discounts and excluding shipping costs.

6. return

We offer you within the legal right of withdrawal (clause 3) to return the goods within the legal period. If you wish to return items from your order in the International Flyfishers Club online store, this should be done in the same way as was delivered.

7. delivery options

Deliveries are possible to different countries (see delivery and shipping costs). We inform you about the delivery time on the respective product page. For deliveries outside Germany, the delivery time is updated after entering the delivery address.

8. deliverability

If a certain item is not available, we will inform you about the unavailability before accepting the order. In this case, a contract is not concluded. We will refund any consideration already received.

9. payment

You can find out about possible payment methods on the corresponding subpage. The goods will be delivered after receipt of payment.

The invoice for your order will be sent to you together with the delivered goods.

10. warranty

Unless expressly agreed otherwise, your warranty claims shall be governed by the statutory provisions of the law on sales (§§ 433 et seq. BGB). Insofar as we grant you a seller’s warranty, the details result from the warranty conditions, which are attached to the respective delivered item. Any warranty claims are without prejudice to the statutory claims / rights.

If delivered items have obvious material or manufacturing defects, including transport damage, please claim such defects immediately to us or to the employee of the shipping service provider who delivers the items. Failure to make such a claim will not affect your legal rights against us, but it will help us to assert our own claims against the carrier or the transport insurance or our suppliers.

11. liability

Unlimited liability: We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act. We shall be liable for slight negligence in the event of damage resulting from injury to life, limb and health of persons.

In all other respects, the following limited liability shall apply: In the event of slight negligence, we shall only be liable in the event of a breach of a material contractual obligation, the fulfillment of which is a prerequisite for the proper performance of the contract and on the fulfillment of which you may regularly rely (cardinal obligation). The liability for slight negligence is limited to the amount of damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. This limitation of liability shall also apply in favor of our vicarious agents.

13. image rights

All rights to the content that can be accessed via the online store, in particular trademark rights and copyrights, are held by us or our partners. You are obliged to take this into account and undertake not to use any content of our online store, of whatever kind, beyond the ordinary visit to an online store. In particular, the reproduction, distribution and/or publication of content, without our express written consent, is not permitted.

The contractual language is German. German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The applicability of mandatory standards of the state in which you have your habitual residence at the time of contract conclusion remains unaffected by this choice of law.
